Terms of Use for MO Backstage

(1) These terms of use apply to the use of the free members area „MO Backstage" on miriam-olivia.com.

(2) The provider and your point of contact is Miriam Olivia Brinksma (sole proprietorship), Archipel 35-39, 8224 HJ Lelystad, Netherlands, email: [email protected], Chamber of Commerce no. 62728083, VAT ID NL209283208B01 (hereinafter „I").

(3) The offer is aimed at consumers.

(1) MO Backstage is free. After signing up you get access to all published looks and face charts, your personal beauty profile with tailored product recommendations, and the make-up bag with expiry reminders.

(2) It is a voluntary, free offer. There is no entitlement to a particular amount of content or to the permanent availability of individual features.

(3) The content is for information and inspiration. It does not replace dermatological or medical advice. If you have sensitive skin or known allergies, please test new products on a small patch of skin first.

(1) MO Backstage requires a free account. You must be at least 16 years old.

(2) You can register with email and password or via „Sign in with Google". Your details must be truthful and up to date.

(3) Keep your login details secret. The account is personal and may not be shared with third parties.

(1) Using MO Backstage is completely free. There are no fees, no subscription and no payment obligation.

(2) Should a paid offer be added in the future, it will be clearly marked as such and you will be asked expressly for your active consent beforehand.

(1) You use MO Backstage in line with applicable law and these terms of use.

(2) All content provided (looks, face charts, tutorials, texts, images) is protected by copyright. You may use it for your personal, private use, but may not reproduce, distribute or make it publicly available without my prior consent.

(1) I aim for high availability but cannot guarantee it without interruption (e.g. during maintenance or technical faults).

(2) I may further develop, adapt or discontinue MO Backstage and individual features. I will inform you in good time of any material changes to these terms of use.

(1) The usage relationship runs for an indefinite period. You can end it at any time and without giving reasons by deleting your account or sending me a short message at [email protected].

(2) I may end the usage relationship for good cause, in particular in the event of serious breaches of these terms of use.

I am liable without limitation for intent and gross negligence and for injury to life, body or health. In the case of slight negligence I am only liable for the breach of essential contractual obligations and limited to the foreseeable, typical damage. As MO Backstage is free, my liability is limited, within the legally permissible scope, to intent and gross negligence. Mandatory statutory provisions remain unaffected.

(1) The law of the Netherlands applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected.

(2) Should any provision be invalid, the validity of the remaining provisions remains unaffected.
