Terms of Sale – Miriam Olivia Beauty Line

(1) Provider: Miriam Olivia Brinksma, Archipel 35-39, 8224 HJ Lelystad, Nederland, email: [email protected], Chamber of Commerce 62728083, VAT NL002260838B27 (hereinafter "I").

(2) These terms of sale apply to all orders of physical products placed by consumers through my online shop.

(3) Deviating terms are not accepted unless I expressly agree to them.

(1) The presentation of products in the shop does not constitute a binding offer but an invitation to order.

(2) By submitting your order you make a binding offer to purchase the products in your shopping cart.

(3) The purchase contract is concluded once payment has been successfully processed by our payment provider Stripe. You will receive an order confirmation by email.

(1) All prices are final prices in euros including Dutch VAT (21% BTW). Deliveries to other EU countries are also charged at the gross price including Dutch VAT – country-specific VAT calculation does not currently apply.

(2) Shipping costs apply in addition to the product price and are shown before you complete your order (see § 5).

(3) Payment is processed via Stripe. Currently available payment methods: iDEAL, credit card (Visa, Mastercard, American Express), Apple Pay and Google Pay. The amount is charged immediately upon order completion.

(1) I deliver to all EU member states.

(2) Delivery zones: Netherlands (NL zone), Germany/Belgium/Austria/Luxembourg (DE zone) and remaining EU countries (EU zone). Deliveries outside the EU are currently not possible.

(1) Shipping costs depend on the delivery zone:

• Netherlands: €3.95 – free from €50 order value.

• Germany, Belgium, Austria, Luxembourg: €6.95 – free from €75 order value.

• Rest of EU: €9.95 – free from €100 order value.

(2) Estimated delivery time is 3–5 business days (NL), 5–7 business days (DE zone) or 7–14 business days (rest of EU). In exceptional cases delivery may take longer; I will notify you by email.

(3) Shipment is sent as an insured parcel. After dispatch you will receive an email with the tracking number, if provided by the carrier.

(1) As a consumer you have the right to withdraw from the purchase contract within 14 days without giving any reason. The withdrawal period begins on the day on which you or a person you have named takes possession of the goods.

(2) Full details of your right of withdrawal, including the model withdrawal form, can be found in the separate document "Right of Withdrawal for the Product Shop".

(3) In the event of a valid withdrawal I will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered), without undue delay and no later than 14 days from the day on which I received your withdrawal notice. I may withhold the refund until I have received the goods back.

(4) You bear the direct cost of returning the goods.

(1) Statutory warranty rights apply.

(2) If the delivered goods are defective you are entitled to repair or replacement at your choice. If this fails you may reduce the price or withdraw from the contract.

(1) I am liable without limitation for intent, gross negligence and injury to life, body or health; otherwise in accordance with the law.

(2) Cosmetic products are for external use only. Please follow the application instructions on the packaging. If you have known allergies or sensitive skin, test the product on a small area of skin first.

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr – I am neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

(1) Dutch law applies. If you are a consumer habitually resident in another EU member state, the mandatory consumer protection provisions of your country of residence remain applicable.

(2) Should any provision be invalid, the remaining provisions shall remain in force.
